This is not legal advice. It is a plain-English summary of public city rules. Codes change, posted code text can lag new ordinances, and some rules have been challenged in court. Confirm with the permit office linked below before your team hits the street.
- Promotional or commercial activity on a street, sidewalk or curb lane needs a Street Event permit from the Street Activity Permit Office (SAPO). A pedestrian plaza needs a Plaza Event permit instead.
- Sampling needs no SAPO permit if the items stay on your person. Setting anything down (a table, banner, cooler) needs one. Sampling from the back of a parked vehicle is prohibited.
- SAPO's 2026 rules define a commercial or promotional event as one that promotes a product or company. Small street event applications are due 14 days ahead, and insurance is required for commercial and promotional events.
- Amplified sound needs an NYPD sound permit. Food handed to the public needs a Health Department temporary food license.
- No flyers on cars: state Vehicle and Traffic Law 375(1) bars handbills on windshields, and Executive Order 40 assigns enforcement to NYPD and Sanitation, with a presumption against the business named on the flyer.
- No posting on lampposts, poles, trees, bus shelters, signs, hydrants and similar items (Admin Code 10-119).
Verifywhether plain hand-to-hand flyering with nothing set down needs any permit; current NYPD sound permit lead time.
