This is not legal advice. It is a plain-English summary of public city rules. Codes change, posted code text can lag new ordinances, and some rules have been challenged in court. Confirm with the permit office linked below before your team hits the street.
- The city's special events office (DCASE) states: "Marketing activations are NOT permitted on public rights of way." Activations must be on private land, and the city points brands to Chicago Park District properties.
- The code allows commercial material hand to hand only, one piece per person unless they ask for more (MCC 10-8-270).
- No flyers on cars, and no handing material to people in cars (10-8-310).
- No doorknob hangers or loose drops at doors, and nothing where "No Soliciting" is posted (10-8-271). No posting on poles, trees, hydrants, bridges or bus shelters (10-8-320). The business promoted is presumed to be the distributor.
Verifywith DCASE whether its "no activations on the public way" policy covers walking teams handing out flyers, which the code itself allows.
